Publication of the Definitive Resolutions of the Aid for the Promotion of applications for Patents and Utility Models in Spain and abroad

On November 18, 2021, the Definitive Resolutions of the grant applications corresponding to the 2021 call for Aid for the Promotion of applications for Spanish Patents and Utility Models and abroad have been published.

The two main objectives of these grants are:

• To stimulate the international protection of technology through patents or utility models, as well as to contribute to the improvement of the competitiveness of those private sector entities that have undertaken the search for markets outside of Spain.
• Promote the protection of national inventions of SMEs and individuals through patents or utility models.

The resolution puts an end to the administrative procedure in accordance with art. 63.2 of Royal Decree 887/2006, of July 21, which approves the Regulation of Law 38/2003, of November 17, General Subsidies. An optional appeal for replacement may be filed against it before the Director of the Spanish Patent and Trademark Office, OA, within a period of one month from the day following its publication in the SPTO's electronic headquarters, in accordance with the provisions of articles 123 and 124 of Law 39/2015 on Common Administrative Procedure of Public Administrations, or, within a period of two months, counting from the day following the aforementioned publication, contentious-administrative appeal, that must be filed before the Central Courts of Contentious-Administrative, all in accordance with articles 9.1.c), 14 and 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
