Public consultation on the international harmonization of patent lawThe OEPM participates in Group B+ created within the framework of the World Intellectual Property Organization (WIPO) to promote and facilitate progress on the key issues being examined at WIPO and, in particular, to advance in the substantive harmonization of the Patent law, with the OEPM being one of the participants in this subgroup. This group aims to explore the possibility of advancing in the international harmonization of patent law, more specifically in relation to:
The so-called trilateral (made up of associations from the US, Europe and Japan) has been working for a few years on the preparation of a proposal for the international harmonization of patent law. The FICPI (International Federation of Intellectual Property Attorneys) and the AIPPI (International Association for the Protection of Industrial Property) have also drafted harmonization proposals. The president of group B+ has requested that the industrial property offices of the member states consult their users about their opinions regarding the international harmonization of patent law. For all these reasons, the European Patent Office (EPO) has prepared the following questionnaire for use in the European member states of the European Patent Convention, which is accompanied by an explanatory document. The questionnaire asks questions about the harmonization proposals made by the trilateral, the FICPI and the AIPPI. The public consultation will end on May 15, 2022.
