Would you know how to recognize a counterfeit toy?

Counterfeits are not only financially detrimental to companies and society in general, but they are also a risk to the health of consumers. In the case of children's products, counterfeits pose a serious health risk to the most vulnerable users, such as children.

According to the qualitative study on the risks of counterfeiting for consumers published by the European Union Intellectual Property Office (EUIPO) in 2019, toys are the most counterfeited product type, followed by clothing, textiles and fashion items. Children are the end users of 80% of declared dangerous and counterfeit goods (toys, childcare articles and children's clothing).

The study notes that the adjective “dangerous” is commonly used in statements and texts when certain types of counterfeit goods are seized. However, the potential risks that these products pose to consumers are not always evaluated. In addition, counterfeits are destroyed once the holders of industrial property rights confirm their illegal nature, as established by Regulation (EU) 608/2013, so the products are not analyzed to determine the potential risks involved. its use. This is one of the reasons why there is no clear vision of the phenomenon of dangerous counterfeit products in the EU and that efforts to collect information on the subject need to be redoubled.

One of the initiatives carried out to obtain more information about the risks posed by counterfeit toys, both for health and for society or the environment, is the SAFE or FAKE Project that is being developed by the Technological Institute of Children's Products and Leisure (AUJI) with the support of EUIPO.

The purpose of this project, aimed at primary school children and teachers and where the toy is the driving vehicle, is to learn concepts such as what industrial property is, and what risks the consumption of counterfeit toys entails.

Within the framework of this project, educational and awareness materials are being developed on the importance of industrial property and the risks of counterfeiting for health, the economy and the environment.

The SAFEorFAKE Toolkit will be available on the website developed for the project https://www.safeorfake.eu/ , and includes a series of playful-educational materials that can be used at home or in extracurricular activities.
