How is a Industrial Designs registered in other States?

1. DIRECTLY

Country by country, by filing the relevant application in each of the countries in which you want to register the industrial design, claiming priority by right of a first filing in Spain (to not renounce the novelty or unique nature). You can find the websites of the major national offices at this link.

2. By means of an INTERNATIONAL DESIGN

Through this procedure, regulated under the The Hague Agreement (Geneva Act), protection may be obtained in numerous countries by filing a single application with the World Intellectual Property Organisation (WIPO) (Geneva), with the registration having the same effect as if the application had been filed in each of the designated countries. Each country can grant or refuse protection.

If the application is filed with the SPTO, a forwarding fee (international registration fee before the SPTO) will be applied.

The duration of this registration is five years, and it can be renewed up to a maximum number of years which varies by State.
