How do I protect an industrial design in Spain?
Protection can be obtained in Spain via several administrative routes:
- National route. The application is prepared following the requirements established by LAW 20/2003 OF 7 JULY FOR THE LEGAL PROTECTION OF INDUSTRIAL DESIGN.
- Community route. There is also the possibility of obtaining a COMMUNITY DESIGN through a single application, which the applicant can choose to submit to the SPTO for transfer to the OHIM or directly to the OHIM (Alicante). The design is, for all legal purposes, unique, and will be granted, rejected or cancelled across the entire European Union territory.
- International route. This procedure is regulated by the Hague Agreement, which comprises the 1934, 1960, 1967 Acts, the 1975 Geneva Protocol and the 1999 Geneva Act, enabling a simultaneous application in 57 countries or regions.
