How can you check if an invention is already registered?

You can perform a free search on our website (www.oepm.es), by going to the DATABASES option, where you can access both a national patent database (INVENTIONS IN SPANISH - INVENES) or a foreign patent database (INVENTIONS IN OTHER LANGUAGES - ESPACENET).

If you perform a search in the INVENES database, the enquiry language will be Spanish, whereas on ESPACENET, the search should be performed in English.

In both cases, when you access the database a series of fields will open which enable you to enter different search criteria.

For example, if you go to the Spanish database, you can use words from the title-abstract that define the object you wish to search for (for example "wheelchair"). A series of documents will be listed that include these words in their title and which can be viewed.

If you find one or a number of documents that you are interested in, use the international classifications of these to complete the search.

On the SPTO website you will find a number of examples of how to perform these searches in the section:

You are here:How to perform a search

You can also request this type of search through our Office, although in this case you will have to pay a fee of 21.65 euros (including VAT) for the Spanish database and 85.86 euros for international searches.

These are the minimum applicable fees, but they may be higher depending on the number of results obtained.

To perform these searches you will need to provide us with a description of the object of the search and your full details - address, telephone number, etc.

Once the search has been carried out, we will send you the corresponding payment forms and then the result.

For more information on these services we recommend that you visit the Technological Information Service - Retrospective searches section on our website and contact difusión@oepm.es
