How do I protect a trademark in Spain?

Protection in Spain may be obtained in several ways:

  • National channel. The application is made following the requirements set out in Law 17/2001 of 7 December on trademarks.
  • European Community channel: A COMMUNITY TRADEMARK may be obtained by making a single application that the applicant can either present to the SPTO to be forwarded to the OHIM, or directly to the OHIM (Alicante). This trademark is a single mark to all effects, and is granted, rejected or cancelled across the entire European Union territory.
  • International channel: protection may be obtained in up to 78 countries (including Spain) by making a single application to the SPTO, who will forward it to the WIPO International Office (Geneva), and the registration will have the same effects as if the application had been presented in each of the designated countries. Each country can grant or refuse protection. This is a single application but once it is registered in all the designated countries, it produces a set of national registrations as if it had been applied for country by country.
