What should I do if I want to protect a trademark abroad?

Protection abroad may be obtained in several ways:

  • DIRECTLY country by country, by making the relevant applications in each of the countries in which you wish to register the trademark.
  • By means of an INTERNATIONAL TRADEMARK.
  • By means of a COMMUNITY TRADEMARK.

All the relevant information on national, international and community trademarks can be found on our website www.oepm.es under DISTINCTIVE SIGNS — TRADEMARKS AND TRADE NAMES.There you will find all the information about registering international trademarks under the Madrid System as well as comprehensive information about community trademarks.

If you wish to register a community trademark, we recommend consulting the information on the following website: www.oami.europa.eu

In order to register an international trademark under the Madrid System, it is ESSENTIAL that the application is based on a national trademark (a community trademark is equivalent to a national trademark). Please refer to the INTERNATIONAL TRADEMARK section of our website, where you will find all the information you need on this type of protection, including forms, fees, member countries, etc.

For countries that are not members of the Madrid System and do not belong to the European Union, the registration must be processed separately in each country in accordance with their applicable legislation and requirements. From the Interesting addresses and links section of our website, www.oepm.es, you can access the websites of other National Industrial Property Offices.
