WHAT IS A TRADEMARK?

A trademark is a title that gives the owner the exclusive rights over the use of a sign to identify a product or service on the market.

Trademarks can be words or word combinations, images, figures, symbols, graphics, letters, numbers, three-dimensional shapes (wrappers, packaging, the shape of a product or its likeness).

See Law 17/2001 of 7 December on Trademarks.

The protection afforded by Distinctive Signs has a duration of ten years from the date of application and can be renewed indefinitely. A fee must be paid to ensure that Distinctive Signs remain valid (a different scale of fees applies to trademarks under provisional procedure, please contact the office for details).
