The Spanish Patent and Trademark Office is attached to the Ministry of Industry, Energy and Tourism, in accordance with Royal Decree 1182/2008 of 11 July, governing the development of the basic organic structure of the Ministry of Industry, Energy and Tourism, fixing this attachment to the Undersecretariat for Industry, Tourism and Trade and designating the Under-secretary as the hierarchical superior of the SPTO.

The current SPTO structure is the following:

• The President of the organisation is the holder of the Secretariat of Industry, Energy and Tourism in accordance with the thirteenth additional provision of Law 17/2001 of 7 December on trademarks.
• Director of the Organisation.
• General Secretariat.
• Department of Patent and Technological Information.
• Distinctive Signs Department.
• Legal Co-ordination and International Relations Department.
• Information Technology Division.
