A BRIEF HISTORY
WHAT WILL YOU
FIND IN THE SPTO
ARCHIVES?
The Spanish Patent and Trademark Office (SPTO) is an auton-
omous body attached to the Ministry of Energy, Tourism and
the Digital Agenda which is responsible for the State’s admin-
istration regarding industrial property.
As a result of this activity, an archive has been created with the
aim of collecting, preserving and disseminating all the docu-
ments produced by the SPTO and the institutions which act-
ed as its predecessors as of the adoption of the first Spanish
law on patents: the Royal Decree of 27 March 1826 on indus-
try privileges. Two main fonds make up the SPTO archive:
• The historical fonds: contain documents dated between
1826 and 1939
• The administrative fonds: contain the documents dated be-
tween 1940 and the present day
Since 1999, the SPTO collaborates actively with the Universi-
dad Autónoma de Madrid to collect bibliographic data and
study the historical archival fonds of the Patent and Trade-
mark Office.
The SPTO is the result of a long institutional change whose
origins could be considered to be the Royal General Board of
Trade, created in 1679, responsible for examining inventions
and proposing to the King the granting of letters patent.
The Board was succeeded by the following entities and insti-
tutions:
• The Royal Cabinet of Machines of the Buen Retiro (1792-
1824),
• Royal Conservatory of Arts and Crafts (1824-1850),
• Royal Institute of Industry (1850-1887), which later became
the Royal Conservatory of Arts and Crafts integrated into the
new institution,
• The Special Directorate for Patents, Trademarks and Indus-
try of the Ministry of Development (1887-1888),
• Department of Patents and Trademarks belonging to the
Ministry of Development (1888-1902),
• The Industrial Property Register (1902-1975), integrated into
the different ministries responsible for this area,
• The Industrial Property Register (1975-1992), an autono-
mous body,
• The Spanish Patent and Trademark Office from 1992 to the
present.
At the same time as this evolution, developments in legisla-
tions and the appearance of new modalities of industrial prop-
erty also came about.
A total of 430,895 files together with their corresponding
record books make up the historical fonds.
The documents are classified as administrative files,
specifications, maps, record books (entry, registration
and payment), and albums.
They also include objects and three-dimensional de-
signs, and material and metal as well as chemical prod-
uct samples.
