Can the SPTO provide information on whether a trademark or trade name has already been registered?

Yes. The SPTO offers a search service which, for a fee, can provide relevant information about the suitability of a sign for registration. However, this report does not prejudge any decisions adopted by the SPTO in the event that a trademark application is received for the protection of the sign in question, or if a court should make a decision in that regard.

The distinctive sign background searches are carried out subject to payment of a fee. This fee will vary based on the products or services used for the search. Please contact the SPTO information service for further information on how to request the search service.

The SPTO website (www.oepm.es) also includes a trademark locator that can be accessed free of charge. We recommend that you carefully read the instructions and information provided on the site to perform the searches and interpret the results correctly.
