The Spanish Patent and Trademark Office (OEPM), an Autonomous Organization assigned to the Ministry of Industry, Tourism and Trade, has its registered address at Paseo de la Castellana, 75, 28071-Madrid, with Fiscal Identification Code Q2820005C

The Spanish Patent and Trademark Office (OEPM), offers access to its electronic bulletin (from now on referred to as the Bulletin) under the terms of use which are indicated in this Legal Notice

Access and use of the Bulletin assigns the condition of user and implies the understanding and full acceptance of these conditions without reserve.

Conditions for accessing and using the Bulletin

Access to the Bulletin and its use are open and free, however the Spanish Patent and Trademark Office (OEPM) reserves the right to place conditions on access and modify the terms and conditions of its use, without previous notice.

The user agrees to use the Bulletin properly and in accordance with current legislation including this Legal Notice, refraining from reproducing, copying, modifying and commercializing its content, except for cases authorized by Law or expressly agreed to by the Spanish Patent and Trademark Office (OEPM).

The user guarantees the authenticity of the data used within the Bulletin and, in such cases, is obliged to keep it current, thereby being held accountable for any inaccuracies or false declarations carried out.

The user is held accountable for damages that could arise as a consequence from using the Bulletin with injurious aims against the interests of the Spanish Patent and Trademark Office (OEPM) and third parties.

Data protection

The Spanish Patent and Trademark Office (OEPM), in compliance with the Law 15/1999 of December 13 for the Protection of Persona Data, guarantees the security and confidentiality of personal data provided by users.

Users consent the incorporation of their personal data into the automated file which the Spanish Patent and Trademark Office (OEPM), as being held accountable, will treat confidentially and exclusively with the aim for which it was collected. The Spanish Patent and Trademark Office (OEPM) can cancel data in the event that it's inaccurate or no longer needed for its aim.

The user, for his or her part, can revoke the given consent and exercise the rights of access, rectification, cancellation and opposition, making recourse to The Spanish Patent and Trademark Office (OEPM) that appears in this Legal Notice.

Links and cookies in the Bulletin

The Bulletin provides services for linking to and searching other web pages and content that may be property of third parties (from now on, referred to as linked sites), but the Spanish Patent and Trademark Office (OEPM) does not take responsibility for results that could stem from the user accessing or using such sites.

When the user considers that a linked site has illicit or inadequate content, he or she can make the Spanish Patent and Trademark Office (OEPM) aware of this without the obligation of having to invalidate the link.

The existence of linked sites does not assume that there exists any agreement or any identification between the Spanish Patent and Trademark Office (OEPM) and the owner of the linked sites.

To facilitate navigation, the Bulletin uses cookies, reduced size data files, which are stored in the user's computer, but without the possibility of reading data on his or her hard disk. Information of these files is anonymous, therefore it can't be associated with any user, nor does it allow for user identification.

Exclusion of responsibility

Regarding the content of the Bulletin, the Spanish Patent and Trademark Office (OEPM), does not take responsibility for damages that could result to the user and third parties from actions and decision that they take based on this content.

Regarding the quality of information, the Spanish Patent and Trademark Office (OEPM) is neither obliged to control the existence of harmful elements or computer programs, nor is it held accountable for damage produced in the computer equipment of users while connected to the Bulletin. The user takes responsibility, under all circumstances, for its detection and elimination.

Regarding the availability of the Bulletin, the Spanish Patent and Trademark Office (OEPM), does not take responsibility for any type of damage caused to the user for any type of failure that prevents connection to the Bulletin or produces its interruption or cancellation.

Communication of illicit and unsuitable activities

When the user has knowledge that the linked sites redirect to pages containing illicit, harmful, violent or immoral content, he or she can make the Spanish Patent and Trademark Office (OEPM) aware of this, whereby the reception of this notification doesn't presume that the Spanish Patent and Trademark Office (OEPM) has effective knowledge of such content communicated by the user, in accordance with that's established in the Law on Information Society Services and Electronic Commerce.

Intellectual and industrial property

Access to the Bulletin does not assign the user any right concerning trademarks, trade names and distinctive signs that appear within them. Any type of reproduction, distribution, commercialization or modification of content (texts, graphics, images, computer codes, etc.) carried out by the user and which has not been expressly authorized, constitutes an infraction of the rights of intellectual and industrial property, therefore it can't be assumed that the user has been granted any right or faculty beyond what is needed for using the Bulletin.

Jurisdiction and legislation

The present Legal Notice is ruled in its entirety by Spanish Law. Any controversy derived from access or use of the Bulletin will be submitted to the courts of Madrid .
