Regulations for Industrial Property Agents from other countries of the EU

On September 28, the Order which regulates the validity of professional qualifications for performing, in Spain, the activity of Industrial Property Agent for citizens of the European Union was published in the Official State Bulletin (No. 235 of 2010). It develops, in reference to the before-mentioned profession, the provisions of Royal Decree 1837/2008, which are incorporated into Spanish law Directives 2005/36/EC and 2006/100/EC of the European Parliament and Council on the validity of professional qualifications, as well as certain aspects of the practice of law.

The Order, which entered into force on September 29, represents, therefore, the loss of transitory effect of the Order dated December 27, 2000, from which Royal Decree 1665/1991 was established on October 25, in recognition of higher education diplomas of Member State citizens who require advanced training of at least three years in the area concerning the profession of Industrial Property Agent.

The main inclusions of the new validation system are:

  • The comprehensive review of the previous regulation, with the aim of improving the clarity and facilitation of the procedure, which results in a clearer division of this into two distinct parts: title validation and the aptitude test.

  • The establishment of a maximum resolution period of four months regarding the acknowledgement of title and the value of lack of response.
