Modification of article 79 of the Patent Law by that of law 25/2009
Law 25/2009, of December 22, which modifies several laws to adapt to the law on free access to service activities, and its application (Official State Bulletin, December 23, 2009), which came into force on December 27, 2009, has resulted in the modification of Article 79 of Patent Law 11/1986, dated March 20, concerning laws on Industrial Property.
Specifically, article 12 of Law 25/2009 carries out the aforementioned modification in two areas:
The elimination of the need to guarantee, via certified document, licenses and transfers of patents and utility models, by facilitating the filing of these licenses and transfers to holders.
The new version of article 79 of the patent law includes a qualification in favor of the regulations for applying the law so that it can determine, from now on, requirements needed to carry out filings. Doing so eliminates significant rigidity inherent to the system, whereby flexibility is gained, assigning the Government the task of adapting the regulation's content to the changing circumstances of the future.
