Study on artificial intelligence and the defense of Industrial Property rightsThe Study Center of the Association for the Defense of the Trademark (Andema) and the Spanish Patent and Trademark Office, O.A. (SPTO), presented on September 22 the first study carried out in Spain that analyzes the applications of artificial intelligence in the defense of trademarks and Industrial Property rights. The research has been prepared by the Industrial Property consultant ClarkeModet. The emergence of artificial intelligence (AI) has created a new model in the defense of industrial property (IP) rights, affecting both the services available in this area (surveillance tools, protection mechanisms based on blockchain technology), as well as to the rights to be protected (metaverse or third generation trademarks) and even to the holders of the rights (avatars and robots). This study highlights that Spain is a leader in AI surveillance solutions applied to the defense of industrial property; however, it ranks 22nd in terms of origin of AI patents. The actors involved in the world of IP have no doubt that AI will play a very important role in the creation of new strategies and methods of protecting their rights. Despite this, 50% of those surveyed for this study identify ignorance as the main barrier to its adoption, apart from other reasons such as cost (24%), legal insecurity (16%) or low efficiency (7%). ), among others.
