Geographical Indications Procedures

The launch on December 1 of the new form of protection for geographical indications for artisanal and industrial products entails a series of changes to the website and electronic headquarters of the SPTO.

Thus, since December 10, a new multi-procedure for geographical indications for supra-regional geographical indications has been available on the OEPM's electronic headquarters.

This multi-procedure must be used to submit documents in the following sub-procedures relating to supra-regional geographical indications for artisanal and industrial products (IGAI):

• Submission of oppositions at the national stage.

• Correction of defects in an opposition at the national stage.

• Request for extension of the consultation period between the applicant and the opponent at the national stage.

• Response to the transfer of oppositions at the national stage.

• Request for a normal amendment (Article 31.5 of Regulation (EU) 2023/2411 of the European Parliament and of the Council of October 18).

• Correction of defects in a request for a normal amendment.

• Supplementary documents in procedures at the national stage.

• Other requests related to the supra-regional geographical indication file, at the national stage.

• Self-declaration of compliance with the specifications.

In order to incorporate this section on geographical indication procedures, certain modifications have been made to the electronic headquarters. The “Consultations” procedures will no longer be part of the navigation menu at the top, but will be included in “Common procedures.” Similarly, each of these procedures (access to BOPI, file consultation, My OEPM, and OpenData: Open Access Data) can be accessed via the icons at the bottom of the main menu on the website.

A series of forms has been published on our website for the submission of applications via this new multi-procedure for geographical indications. The forms have been classified as follows:

• Applications relating to a supra-regional geographical indication at the national stage

• Procedures following applications for registration, normal modification, EU modification, or cancellation, at the national stage, of a supra-regional geographical indication

• Other procedures

The forms specific to the procedures that must be carried out through the multi-procedure of the OEPM's electronic headquarters are identified with the form number and “OEPM,” while the procedures that must be carried out on the GI Portal appear with the tagline “GIportal” and refer to the forms published by EUIPO.

A subsection with direct access to the GI Portal has also been created.

The GI Portal is a digital system of the European Union Intellectual Property Office (EUIPO) for the electronic submission of applications for geographical indications for artisanal and industrial products.

This platform can be used to submit applications for registration, modification of the Union, and cancellation of geographical indications at the national stage, as well as to respond to notifications of defects. When applications receive a favorable decision and the Union stage begins before the EUIPO, the procedures will be carried out through this platform.

On the other hand, as we have already seen, there are certain procedures in the national phase that must be carried out through the electronic headquarters of each competent national authority.
