Arbitration and Industrial Property

The symposium “Arbitration in the Area of Industrial Property” was held at the SPTO headquarters on October 20 th.

Arbitration is an extremely useful tool for both resolving and preventing conflicts, especially in the globalized world we live in where commercial transactions are not only increasing in number, but in complexity as well.

The fact that arbitration sentences, known as arbitration awards, are recognized and carried out in most countries, is proof of their credibility.

The Spanish Arbitration Court forms part of the Superior Council of Chambers of Commerce, Industry and Navigation and is in charge of administering and carrying out commercial arbitration submitted by Parties anywhere throughout the world and in practically all economic sectors.

The symposium highlighted the possibilities that commercial arbitration offers in the area of Industrial Property in Spain, placing special focus on commercial agreements on the use of Industrial Property once it's registered. Moreover, arbitration was considered from the traditional point of view, such as commercial arbitration and as a means of protecting investments foreseen in multilateral treaties.

Those who participated in the symposium included Bernardo Cremades, President of the Spanish Arbitration Court, Ignacio de Castro, Assistant General Manager of the WIPO Arbitration and Mediation Center, José Manuel Otero Lastres, Department Head of Commercial Law at the University of Alcalá de Henares, José Antonio Moreno , Assistant General Manager of the Spanish National Trademark Defence Association (ANDEMA) and Alberto Casado, General Director of the SPTO.
