New Procedures at the Electronic Office of the SPTO
So far, all procedures following the main application of different types of Industrial Property are carried out in the “Form for Other Procedures,” where you choose the category and procedure required. Thanks to the new application made available to the public, a breakdown has been performed of the various procedures and corresponding forms classified by type of registration category, which can be accessed more quickly and safely.
As an added functionality, procedures requiring a fee have been integrated into our accounting database. Payment must be made electronically in advance through the "Virtual Window" so that once you access the corresponding procedure details of the payment are indicated. Failure to meet these requirements does not allow for the transmission of the application or document.
In addition, this new display mode allows users to apply the 15% discount to the amount of the applicable fee for each case.
More Applications
Access and information on this new application is available in the Electronic Office in the Catalog of Procedures. In the option “Presenting Forms for Other Procedures” a new window opens where various procedures are sorted by category: Distinctive Signs, Industrial Designs, Resources, Inventions and Other Procedures for Agents and Representatives. Access is provided through Digital Certificates and information is given on those associated with a prepayment.
For its part, the procedure “General Purpose Electronic Application” sent to the SPTO that doesn’t correspond to any category is for generic type requests not related to any procedure referred to in the various registration categories, and should not be used for an application or document already included in the Catalog.
In regards to Inventions, the previous system has been maintained, pending the implementation of the corresponding payment control. However, a 15% discount will be applied to applications and documents in this application, subject to compliance with the requirement of prior electronic payment.
Additionally, it should also be noted that certain procedures and applications that currently can be carried out by SIGEM will soon only be made available through the EOLF electronic filing platform.
