Electronic Filing of Administrative Resources

The SPTO is launching a new electronic presentation program for Internet Appeals:

•By means of the electronic Appeal, the SPTO offers a measure outlined in its Strategic Plan adapted to Electronic Administration.

•This measure facilitates procedures for filing administrative Appeals to SPTO resolutions.

On June 22, the Spanish Patent and Trademark Office (SPTO), within its strategic plan for adapting to Law 11/2007 for Electronic Access by Citizens to Public Services, made electronic Appeal filing available to the public on its webpage (www.oepm.es).

By means of this application, both individuals and professional representatives will be able to present, in absolute legality, administrative appeals in an entirely secure way.

Thanks to this new system, users will be able to:

  • Fill out the application directly from their computer
  • Attach documentation and complementary written documents as required
  • Sign and send in the appeal filing form

Advantages of these procedures to the user are: 

  • Time savings
  • Immediate delivery of proof of presentation
  • Maximum security

To ensure confidentiality of procedures, those interested must possess an electronic National Identification Number or another certificate that allows for advanced electronic signatures which is recognized by the Public Administration.

Electronic Appeal filing implies paying a fee, which can be done before or at the time of electronic filing. Payment can be made simultaneously through electronic means.
