Geographical Indications for Artisanal and Industrial Products Regulation published at national levelGeographical Indications for Artisanal and Industrial Products Regulation published at national level Royal Decree 1190/2025, of December 26, establishes the national procedure for registering this new type of industrial property right. The European Union recently extended the protection afforded by Geographical Indications, which until then had been limited to the agri-food sector, to crafts and industry. These distinctive signs grant industrial property (IP) rights to products whose manufacture is closely linked to the tradition of a specific territory. Regulation (EU) 2023/2411 of the European Parliament and of the Council of October 18, the rule governing this new protection system, establishes that the registration procedure for Geographical Indications will be carried out in two phases: the national phase and the Union phase. Royal Decree 1190/2025 designates the OEPM as the competent national authority at the national stage for Geographical Indications of Handicraft and Industrial Products and completes the national registration procedure for geographical indications whose territorial scope exceeds that of an autonomous community. It specifies such important procedural aspects as the opposition procedure and the role of the OEPM as a liaison office between the competent regional bodies and the EUIPO. It also includes provisions that will be applicable to geographical indications at the regional level. This Royal Decree reflects the inter-administrative collaboration that will be necessary for the implementation of the system. It therefore provides for the creation of a coordination committee for geographical indications for artisanal and industrial products, as a body for cooperation between the SPTO and the autonomous communities. Finally, this Royal Decree establishes the official control system for supra-regional geographical indications, designating the SPTO as the competent national authority for verifying compliance with the specifications to which producers covered by the protection of a given Geographical Indication must adhere.
