Benefits of geographical indication protection

The aim of geographical indication protection for craft and industrial products is to preserve and develop cultural heritage, boost profitability and increase the appeal of traditional craft professions.

 

For consumers, geographical indication protection guarantees the quality and authenticity of a product, including its production methods and/or the traditions associated with its geographical origin.

 

For producers, it provides a way to enhance the value of their products and craftsmanship, as well as serving as an effective tool against unfair competition and counterfeiting. This protection will thus incentivise the production of quality products and have an overall positive impact on the regions where these products are made. It will contribute to job creation and strengthen the competitiveness of manufacturers and SMEs in these areas. It will also have a positive impact on national and regional tourism.

 

Geographical indications shall be protected against:

  • any direct or indirect commercial use of the geographical indication in respect of products not covered by the registration, where those products are comparable to the products covered by the registration or where the use of the name exploits, weakens, dilutes or is detrimental to, the reputation of the protected geographical indication;
  • any misuse, imitation or evocation of the name protected as a geographical indication, even if the true origin of the products or services is indicated or if the protected geographical indication is translated or accompanied by an expression such as ‘style’, ‘type’, ‘method’, ‘as produced in’, ‘imitation’, ‘flavour’, ‘fragrance’, ‘like’ or similar;
  • any other false or misleading indication as to the provenance, origin, nature or essential qualities of the product that is used on the inner or outer packaging, on advertising materials, in documents or information provided on online interfaces relating to the product, as well as the packing of the product in a container liable to convey a false impression as to its origin;
  • any other practice liable to mislead the consumer as to the true origin of the product.

 

Producers who meet the requirements of the product specification may use the protected name, the Union symbol established for protected geographical indications, the mention 'Protected Geographical Indication' and the abbreviation 'PGI' on the designated products.

Additionally, any producer of a product covered by a protected geographical indication may join the producer group that applied for the geographical indication registration at any time, provided they comply with the product specification.
