The requested trademark will be published exactly as it was submitted, in other words, it must consist of the proof including the graphic element and, if any, denominative elements included in the sign for which the trademark application is being submitted.
The application will be considered as totally or partially withdrawn, depending on the nature of the faults in question.
En algunos supuestos también podría obtenerse el registro de una marca o nombre comercial similar a otros anteriores, cuando los productos, servicios o actividades que distinguen sean lo suficientemente dispares, como para no inducir a error o generar un riesgo de asociación, por ejemplo, DULCILIA concedida para distinguir “mantas” de la clase 24, no impediría el registro de la misma denominación para amparar “una publicación periódica” de la clase 16. Este llamado “principio de la especialidad“, quiebra cuando se trata de marcas renombradas. La marca renombrada goza de una protección legalmente reforzada, y no podría concederse, por ejemplo, CAMPOFRÍO para “bebidas alcohólicas” de la clase 33, dado su renombre entre los consumidores.
La OEPM hace con respecto de cada nueva solicitud, una búsqueda informática de anterioridades y cursa un aviso, a efectos meramente informativos, al solicitante o titular de registros anteriores, para que si lo desea, pueda formular oposición. En caso de que no haya oposición de terceros la OEPM no podrá dictar suspenso ni denegar de oficio la nueva solicitud por semejanza con un derecho de propiedad industrial o intelectual anterior, salvo determinados supuestos de denominaciones de origen, indicaciones geográficas, términos tradicionales de los vinos, especialidades tradicionales garantizadas u obtenciones vegetales.
Yes. The SPTO offers a search service which, for a fee, can provide relevant information about the suitability of a sign for registration. However, this report does not prejudge any decisions adopted by the SPTO in the event that a trademark application is received for the protection of the sign in question, or if a court should make a decision in that regard.
The distinctive sign background searches are carried out subject to payment of a fee. This fee will vary based on the products or services used for the search. Please contact the SPTO information service for further information on how to request the search service.
