Wed Apr 25 13:20:00 CEST 2018El pasado 27 de marzo de 2018 se publicó en el Boletín Oficial del Estado, la Orden ETU/320/2018, de 26 de marzo, por la que se establecen los requisitos y condiciones en las que otros habilitados, distintos de los expresamente facultados por los artículos 154.2 y 169.2 de la Ley 24/2015, de 24 de julio, de Patentes, podrán traducir patentes europeas y solicitudes internacionales de patentes a que se refieren dichos artículos.
El apartado 2 de su artículo único dispone que cuando se presente una traducción por alguna de las personas contempladas en el apartado anterior, deberá acompañarse una declaración responsable en la que se manifieste que se cumplen los requisitos y condiciones indicados. A estos efectos, prevé que un modelo de esta declaración estará disponible en la sede electrónica de la Oficina Española de Patentes y Marcas, O.A.
En aplicación de dicha disposición, se comunica que se pone a disposición de público en el siguiente enlace el mencionado modelo de declaración responsable.
On March 27, 2018, Order ETU/320/2018, of March 26, was published in the Official State Gazette, establishing the requirements and conditions under which another qualified, other than those expressly authorized by Articles 154.2 and 169.2 of Law 24/2015, of July 24, on Patents, may translate European patents and international patent applications to which said articles refer.
Paragraph 2 of its unique article provides that when a translation is submitted by any of the persons referred to in the previous paragraph, a responsible statement must be attached stating that the indicated requirements and conditions are met. For this purpose, it provides that a model of this declaration will be available at the electronic webpage of the Spanish Patent and Trademark Office.
In application of said provision, it is communicated that the aforementioned model of responsible declaration is made available to the public in the following link.
